Terms and conditions of use and sale

("Conditions")

1. Who we are. AccentWorld s.r.l. ("Retailer") is the owner of the eCommerce platform ("Online shop") hosted on the site baccobacco.it ("Site"), through which it offers its customers ("Customers") the opportunity to purchase wines, spirits and food goods in general typical of Abruzzo and its surroundings ("Products/o") and produced by members of the Reseller's dropshipping system ("Producers/e").

2. Our Customers. A. On the online shop, both final consumers (B2C sales channel, "Consumers") who want to savor the goodness of the Products, and subjects with a VAT number (B2B sales channel, "Professionals") can purchase, including, by way of example, restaurants, holiday farms, hotel services and other professional operators in the agri-food sector. B. In order for them to be oriented towards the most suitable Products for their needs, the Reseller invites all Customers to use the contact details indicated on the Site - including those of the Manufacturer, if any - to request any advice and information useful for the purchase.

3. Our relationships. The purchase contracts ("Contracts") concluded between the Customers and the Reseller through the Online Shop or through the exchange of electronic correspondence are governed by (i) these Conditions, published and available for consultation on the Site, and (ii) by the order placed on the Online Store ("Order"), if and as confirmed by the Reseller ("Order Confirmation").

4. Your personal data. The Reseller processes the personal data of the Customers according to what is indicated in the Privacy Policy and in the Cookie Policy which can be consulted on the Website.

 

5. Sending the Order, Conclusion of the Contract and condition precedent. A. The Customer places the Order on the Online Shop: (i) choosing the Products from those available and adding them to the virtual shopping cart, (ii) entering the billing (if invoice is required) and delivery data, (iii ) by paying the price (including taxes and delivery costs) according to the methods available. B. When the Reseller sends the Customer the Order Confirmation, the Contract is considered concluded, without prejudice to the suspensive condition of receipt of payment for the Products.

6. Shipping and delivery. A. Unless otherwise communicated in the Order Confirmation and without prejudice to the condition precedent of the payment of the Products, the shipment of the Products is carried out within the times indicated on the Online Shop (usually within 10 working days of payment, except for public holidays and holiday periods), with the Timing indicated on the Site. C. In any case, the delivery times indicated on the Site - or the different ones communicated to the Customer by the Reseller or by the Manufacturer - are indicative.

7. Risk of loss and damage to delivery. The risk of loss or damage to the Products during the delivery transport is (i) always borne by the Professionals pursuant to article 1510, paragraph II, of the Civil Code; (ii) charged to the Consumers, only in the event that the choice of carrier was made by the latter, pursuant to article 63, paragraph II, of the Consumer Code, (iii) charged to the Reseller in the event that the transport is intended for Consumers, pursuant to article 63, paragraph I, of the Consumer Code.

 

8. Recommendations on delivery. Given the nature of the Products and their fragility, the Reseller recommends that Customers always accept delivery "subject to verification" and promptly formalize any specific disputes regarding the number of packages and/or the condition of the packaging, informing the Reseller to contact details on the Online Shop, attaching the photographic documentation, so that the dispute can be forwarded to the responsible party.

 

9. Right of withdrawal. Modes and Effects. A. The Consumer who has purchased on the Online Shop can exercise the right of withdrawal ("Withdrawal") on the purchase of the Products within 14 (fourteen) days of delivery, by sending notice to the Retailer at servizio-clienti@baccobacco.it. B. The Consumer who exercises the Withdrawal within the aforementioned term: (i) returns the Products within 14 (fourteen) days from the communication of the Withdrawal, following the instructions of the Reseller; (ii) fully bears the costs of returning the Products subject to Withdrawal and (iii) returns the Products intact (for example, uncorked bottles and unopened foodstuffs), in the original packaging, complete with packaging and documentation. C. Having verified compliance with all the above conditions and obligations, the Reseller will reimburse the amount paid for the purchase of the products subject to Withdrawal within 14 (fourteen) days of receipt of the returned Products, if possible using the same payment method chosen by the Consumer for the purchase. D. The refund does not include any additional costs attributable to the consumer's choice of a shipment other than the standard delivery method, meaning the cheapest one in relation to the Products being shipped. In the event of a single Order relating to several Products, the refund will in any case only include the delivery costs relating to the Product(s) subject to the Withdrawal.

 

10. Exclusion of Withdrawal. Given the nature of the Products, the methods of use of the same and the need to protect the health and safety of Customers, the Withdrawal is excluded for Products (i) subject to the risk of rapid deterioration or rapid expiry, in accordance letter d) of article 59 of the Consumer Code, and (ii) sealed that have been opened by the Consumer, in accordance with letter e) of article 59 of the Consumer Code.

 

11. Warranty. Duration, methods of exercise and remedies. A. All Manufacturers ensure the compliance of their Products with applicable health, technical and safety regulations and standards under Italian law and European Union law, as well as guaranteeing that the Products are free from lack of conformity and/or or vices. B. The conformity of the Products is guaranteed (i) to the Consumers, for a period of 2 (two) years from delivery, the Consumer being able to report any lack of conformity of the Products within the term of 26 (twenty-six) months from delivery, as provided for by articles 128 and following of the Consumer Code; (ii) to Professionals, for a period of one year from delivery, except as provided below. C. These terms apply on condition that this is possible and compatible with the nature of the Products, without prejudice to the provisions of articles 13 and 14 of the Conditions. D. The Customer who intends to assert a lack of conformity of the Products must promptly notify the Reseller exclusively at the addresses indicated on the Site or by registered mail with return receipt. E. Once the existence of the reported lack of conformity has been assessed, the Customer receives instructions for any possible remedy pursuant to article 135 bis of the Consumer Code.

 

12. Reporting deadlines for Professionals. The Professionals must report defects and/or defects and/or non-conformities of the Products pursuant to articles 1490 and following of the Civil Code, within 8 (eight) days from delivery for obvious defects and 8 (eight) days from discovery in the case of hidden defects, under penalty of forfeiture.

 

13. Warranty Exclusion for all Customers. Any guarantee is expressly excluded in relation to lack of conformity and/or defects that may occur in relation to and due to improper use, not in compliance with the indications and instructions, including those provided by the Reseller and/or by the Manufacturer in the pre and post phase sale, or inadequate or otherwise negligent, imprudent and impertinent storage, taking into account the nature and characteristics of the Products. In particular, the Customer acknowledges and accepts that (i) the flavor of the Products is susceptible to alterations which do not depend on the activity of the Producer, and that (ii) once opened, the Products must be consumed within the time limits indicated. Therefore, the guarantee must be considered excluded in relation to Products not consumed within the indicated term and/or to any dispute attributable to an unwelcome taste of the Products (except for the hypothesis of a "corked" taste of the wine).

 

14. Warranty Limitations for Professionals. The guarantee for Professionals is not applicable or in any case may not operate, in whole or in part, in the event that the Professional has not complied, due to his own fault, with the delivery recommendations referred to in Article 8.

 

15. ODR platform. Complaint presentation. In the event of any disputes, the Consumer can act out of court using the ODR platform established by Regulation (EU) no. 524/2013 and submit a complaint by filling in the electronic form available in the official languages of the European Union. In any case, the place of residence or domicile of the Consumer is competent for any dispute between the Consumer and the Reseller.

 

16. Court of the Professional. The Court of Chieti is exclusively competent for all disputes arising from the Contracts between the Professional and the Reseller.

 

17. Invitation. Customers are invited to notify the Reseller of any disservice they believe to have suffered or in any case any dissatisfaction by sending an email to the addresses indicated on the Site. The Reseller, possibly also involving the Manufacturers concerned, undertakes to seek an amicable solution.
